Terms of Service

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and truthful.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately via our contact form if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or have been inactive for more than 24 consecutive months.

3.1 Free Tier — The free tier provides access to daily horoscopes, tarot readings, the oracle, affirmations, and wellness features without charge.

3.2 Premium Tier — Premium features are available via a paid subscription on a monthly or annual basis. Current pricing is displayed on the Premium page. We reserve the right to change pricing with 30 days' notice to existing subscribers.

3.3 Payment — All payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis. You can update your payment method or cancel your subscription at any time through your account settings.

3.4 Cancellation — You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. No prorated refunds are provided for unused days.

3.5 Refund Policy — All sales are final. We do not offer refunds for any subscription, whether monthly or annual. You may cancel at any time; access continues until the end of your current billing period.

3.6 Free Trials — Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled before the trial ends.

You agree not to use the Service to:

• Attempt to extract, scrape, or systematically download content from the Service for commercial purposes without written permission
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to send spam or unsolicited communications
• Upload or transmit malicious code, viruses, or disruptive content
• Attempt to circumvent security measures, including premium access controls
• Create multiple accounts to abuse free-tier limits or trial offers
• Impersonate any person or entity
• Use the Service in any unlawful manner or in violation of applicable regulations
• Share account credentials with others or resell access to the Service

5.1 Our Content — The Service, including its design, text, graphics, logos, and software, is owned by or licensed to Arcanavana™ and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

5.2 AI-Generated Readings — AI-generated readings produced during your session are provided for your personal use. You may save, print, or share readings for personal non-commercial purposes. You may not republish or commercialise AI-generated readings without permission.

5.3 Your Content — You retain ownership of any content you submit (e.g., questions to the Oracle, community posts). By submitting content, you grant us a non-exclusive, royalty-free licence to use it for the purpose of providing the Service and improving our AI prompts in an anonymised fashion. Do not submit sensitive health, financial, or legal information; we are not liable for any loss or misuse of such information. You are solely responsible for the content you submit and represent that you have the right to do so.

5.4 Feedback — Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation to compensate you.

The Service relies on third-party providers including Supabase, Stripe, OpenAI, and Vercel. Your use of these providers is governed by their respective terms of service and privacy policies. We are not responsible for the practices, availability, or failures of third-party providers. We do not guarantee uninterrupted access to the Service.

The Service may contain links to third-party websites. These links are provided for convenience only. We have no control over third-party sites and are not responsible for their content, accuracy, or privacy practices.

We shall not be liable for any failure or delay in performing our obligations under these Terms when such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, government actions, strikes, labour disputes, power failures, internet or telecommunications outages, third-party hosting or API failures, or any other cause beyond our reasonable control.

To the maximum extent permitted by applicable law, Arcanavana™ and its officers, directors, employees, and agents shall not be liable for: any indirect, incidental, special, consequential, or punitive damages; any loss of profits, revenue, data, or goodwill; any damages arising from your reliance on content provided by the Service; any damages arising from the Chakra Scan or any camera- or image-based feature; any damages arising from third-party provider failures (including Supabase, Stripe, OpenAI, or Vercel); or any damages exceeding the total amount you paid to us in the 12-month period preceding the claim (or, for free users, ten US dollars).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. Subject to that, this limitation applies regardless of the legal theory (contract, tort, strict liability, etc.) and even if we have been advised of the possibility of such damages.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that your data will be retained, backed up, or recoverable. AI-generated readings are produced by large language models and may contain inaccuracies, inconsistencies, hallucinations, or outdated information. We make no representations regarding the accuracy or reliability of any content.

You agree to indemnify, defend, and hold harmless Arcanavana™ and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use or misuse of the Service; your violation of these Terms; your violation of any third-party rights; or any content you submit to the Service.

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. The Service is operated from Arizona. Regardless of where you access the Service from, you agree that these Terms and any dispute arising from them or your use of the Service shall be governed by Arizona law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from these Terms or your use of the Service shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona. Class action claims and class-wide arbitration are waived to the extent permitted by law. The arbitral award shall be final and binding. Notwithstanding the above, either party may seek injunctive relief in the state or federal courts of Arizona to prevent intellectual property infringement or unauthorised access to the Service.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. We have no obligation to provide a refund or credit for any partial subscription period.

You may delete your account at any time. Deletion removes your personal data subject to legal retention requirements as described in our Privacy Policy.

We may update these Terms from time to time. Material changes will be communicated via email (if we have your address) and by updating the "Last updated" date. Your continued use of the Service following the effective date of the updated Terms constitutes your acceptance.

Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arcanavana™ regarding the Service and supersede all prior agreements.

Severability — If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

Waiver — Our failure to enforce any provision of these Terms is not a waiver of our right to do so in the future.

Assignment — You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

Survival — Sections 5 (Intellectual Property), 7 (Limitation of Liability), 8 (Disclaimer of Warranties), 9 (Indemnification), and 10 (Governing Law and Dispute Resolution) survive termination of these Terms.
